The One Ai, LLC Terms & Conditions

Welcome to The One Ai, LLC ("The One Ai," "Company," "We," "Our," or "Us"). These Terms and Conditions ("Terms") govern your access to and use of The One Ai’s services, websites, applications, and products (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, please discontinue your use of the Service immediately.

The following definitions shall apply throughout these Terms:

Affiliate means any entity that directly or indirectly controls, is controlled by, or is under common control with the Company. Account refers to a unique account created for you to access the Service or parts of the Service.

Content includes all information, text, files, graphics, or other materials provided by or through the Service.Subscription refers to the recurring fee-based access to certain features or parts of the Service.

Third-Party Services include any services, content, or platforms provided by third-party vendors that may be integrated with or linked to the Service. You or your refers to the individual or entity accessing or using the Service.

Acceptance of Terms

Your use of the Service is subject to these Terms, our Privacy Policy, Acceptable Use Policy, EULA, Billing & Subscriptions Policy, DMCA Policy, and any other policies we may establish. By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by all applicable terms and policies.

Use of the Service

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you have the legal capacity to agree to these Terms.

You are solely responsible for maintaining the confidentiality of your Account credentials and agree to provide accurate, complete, and current information during registration. Sharing, selling, leasing, or sub licensing your Account or access to the Service is prohibited.

Permitted uses of the Service include accessing software tools, templates, and services for digital marketing and automation purposes. All use must comply with our Acceptable Use Policy.

Use of the Service

Subscriptions and Billing

The Service may be accessed through recurring Subscriptions, billed on a monthly, annual, or other basis as specified during your signup.

You agree to provide valid payment information and authorize The One Ai to charge your method of payment for all applicable fees. Fees are non-refundable except as explicitly stated in our Billing & Subscriptions Policy.

You may cancel your Subscription at any time by submitting a cancellation form. Upon cancellation, all associated data, tools, and content will remain the property of The One Ai and may not be exported or transferred to any third-party platform.

Ownership and Intellectual Property

All data, templates, workflows, and content created or hosted within The One Ai’s platform, including but not limited to client-provided data, remains the exclusive intellectual property of The One Ai. Users are effectively "renting" the tools and templates provided by The One Ai during their Subscription period.

Upon termination of the Subscription, users forfeit all access to content, data, or configurations created through the Service. Unauthorized copying, distribution, sublicensing, or creation of derivative works of any portion of the Service is strictly prohibited.

The Service may integrate with or link to third-party vendors, including but not limited to the following:

The One Ai is not responsible for the content, functionality, or compliance of these third-party services. By using these services through our platform, you agree to their respective terms. See Third-Party Vendor Policy.

Data Protection and Privacy

Your use of the Service is governed by our Privacy Policy, which outlines how we collect, use, and protect your data. You agree to review and comply with this policy.

Prohibited Activities

You may not use the Service for activities that violate applicable laws or these Terms.

Prohibited activities include, but are not limited to:

Sending unsolicited commercial emails ("spam").
Distributing harmful or malicious content.
Using unauthorized bots, scrapers, or similar automated tools.

Limitation of Liability

To the fullest extent permitted by law, The One Ai disclaims liability for any:Indirect, incidental,

or consequential damages.

Loss of data, revenue, or profits arising from your use of the Service.

Our maximum liability will not exceed the amount paid by you to The One Ai in the 12 months preceding the claim.

Termination

The One Ai reserves the right to suspend or terminate your Account for breach of these Terms, non-payment of fees, or any activity that compromises the security or integrity of the Service.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA. Any disputes will be resolved through binding arbitration in Longwood, Florida, as outlined in our Dispute Resolution Policy.

Changes to These Terms

The One Ai reserves the right to amend these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of any modified terms.
